Company fined for illegal earthworks

Auckland Council has successfully prosecuted a business and an individual for multiple breaches of the Resource Management Act (RMA) and a representative charge of dishonestly altering resource consents.  The Auckland District Court imposed fines totalling $138,600 for illegal earthworks at two Warkworth sites, including a 30 per cent uplift for dishonestly altering two resource consents in an unsophisticated attempt to hide the offending, although the individual was ultimately discharged without conviction on the Crimes Act charge.  The charges stemmed from significant non-compliant...
